Section 498A IPC was Enacted to Punish Cruelty by Husband but Now Being Misused: Jharkhand High C...

  • The Jharkhand High Court observed that while Section 498A (cruelty to woman) of the Indian Penal Code (IPC) originally introduced with the laudable object of punishing cruelty inflicted by husbands or their relatives on married women, it is currently being misused.
  • Justice Sanjay Kumar Dwivedi noted that several courts including the Supreme Court have flagged concern over such misuse.
  • The judge added that there are numerous instances, where concerns were expressed by courts over the misuse of Section 498A and the growing trend to implicate the husband's relatives in matrimonial disputes without considering the potential long-term consequences of such complaints going to trial.
  • The High Court further referred to Supreme Court judgments, where the top court had expressed concern over cases under Section 498A being lodged in the heat of the moment, and where omnibus allegations are made to implicate the family members of the husband in matrimonial disputes.

Centre Notifies Appointment of Advocate Biswadeep Bhattacharjee, as a Judge of the Meghalaya High...

  • The Central government notified the appointment of Additional Advocate General (AAG) Biswadeep Bhattacharjee as a judge of the Meghalaya High Court.
  • Bhattacharjee has been holding the post of AAG in Meghalaya since 2018.
  • With the appointment of Bhattacharjee, the Meghalaya High Court will be functioning at its sanctioned strength of four judges.
  • It was established in March 2013, after making suitable amendments in the Constitution of India and North-Eastern Areas (Re-organisation) Act of 1971.

Bombay and Andhra Pradesh High Courts Get New Chief Justices

  • Justice Devendra Kumar Upadhyaya was appointed as the Chief Justice of the Bombay High Court, while Justice Dhiraj Singh Thakur was appointed as the Chief Justice of the Andhra Pradesh High Court.
  • The Supreme Court Collegium had recommended the appointment of Justice Devendra Upadhyaya of the Allahabad High Court as Chief Justice of the Bombay High Court and Justice Dhiraj Singh Thakur, a Bombay High Court judge, as the Chief Justice of Andhra Pradesh High Court earlier this month (July).

Punjab & Haryana Bar Council Elections: Ashok Singla New Chairperson

  • Advocate Ashok Singla was elected the chairperson and advocate Ranvir Singh Dhaka was elected the vice chairperson of the Punjab and Haryana State Bar Council.
  • The elections for deciding the office-bearers of the Punjab and Haryana Bar Council were conducted under the supervision of Advocate General Baldev Raj Mahajan, who served as the returning officer.
  • Ashok Singla, hailing from Sangrur, has previously served as the secretary of the Bar Council in 2005-06 and later as the vice chairperson in 2022-23.
  • The State Bar Council of Punjab and Haryana consists of 25 elected members who are chosen through a preferential voting system from among advocates enrolled in Punjab, Haryana, and Chandigarh.
  • Bar Council of Punjab and Haryana was formed, in 1961, as per the requirement of Section 3 of Advocates Act, 1961 which mandates for each state of India to have its Bar Council.

Justice Sunita Agarwal Sworn in as Chief Justice of Gujarat High Court

  • Justice Sunita Agarwal was sworn in as the 29th Chief Justice of Gujarat High Court. She is the second woman Chief Justice of the Gujarat High Court.
  • Governor Acharya Devvrat administered the oath of office at a ceremony at Raj Bhavan in Gandhinagar, which was attended by Chief Minister Bhupendra Patel, Speaker of Gujarat Assembly Shankar Chaudhary, and Minister of Law and Justice Rushikesh Patel.
  • The Supreme Court collegium had proposed the appointment of Justice Agarwal as the Chief Justice of Gujarat High Court.
  • The top court had stated she is the only woman Chief Justice of an HC as presently (as in July 2023) there is no woman among the Chief Justices of the High Courts in the country.
  • Before her, Justice Sonia Gokani was Chief Justice of Gujarat High Court for a few days till her retirement on February 25, 2023, after which Justice AJ Desai served as the acting CJ.

Justice Gaurang Kanth Sworn in as Judge of Calcutta High Court

  • Justice Gaurang Kanth took oath as a judge of the Calcutta High Court. The swearing-in ceremony was conducted by Chief Justice T. S. Sivagnaman.
  • The Central Government's decision to transfer him came following the recommendation of the Supreme Court Collegium. However, the Collegium rejected his request for a transfer to the Madhya Pradesh High Court or Rajasthan High Court.
  • Justice Gaurang Kanth previously served as a judge in the Delhi High Court, having been appointed on May 18, 2022.
