Supreme Court Disposes of Plea Seeking National Holiday on Birth Anniversary of Netaji Subhas Cha...

  • The Supreme Court rejected a PIL, which sought declaration of national holiday on Parakram Diwas, birth anniversary of Netaji Subhas Chandra Bose.
  • Coming down heavily on the Counsel of the petitioner, the Bench of Chief Justice D.Y. Chandrachud and Justice J.B. Pardiwala noted that the petition was nothing, but a mockery of PIL jurisdiction.
  • The top court of the country noted that there was nothing in the petition that it could grant relief for, since the matter fell under the jurisdiction of the Government of India.

Rajiv Gandhi Assassination: Supreme Court Orders Premature Release of Nalini, Ravichandran, other...

  • The Supreme Court ordered premature release of persons, who were convicted for their role in the assassination of former Prime Minister Rajiv Gandhi.
  • The Bench of Justice B.R. Gavai and Justice B.V. Nagarathna ordered premature release of Nalini Srihar, R.P. Ravichandran and others on the grounds that their conduct inside the prison had been satisfactory and that they had been languishing in jail for a very long time.
  • The Apex Court observed that the order passed in the case of another convict in the case, A.G. Perarivalan, would be applicable to him as well.
  • The top court of the country noted that Nalini, who had a PG diploma in Computer Application, had remained in jail for over three decades and her conduct had been satisfactory.
  • The Apex Court further noted that Ravichandran had undertaken various studies during his time in jail, including a PG diploma in Arts. The convict even collected various amounts for charity, noted the Court and directed for their release, unless they were wanted in any other case.

Govt Appoints 15 Judicial, Technical Members at National Company Law Tribunal

  • The government appointed a total of 15 judicial and technical members at the National Company Law Tribunal (NCLT), which is grappling with a shortage of judges.
  • The NCLT adjudicates matters related to the Insolvency and Bankruptcy Code (IBC) and companies law.
  • As many as 9 judicial members and 6 technical members were appointed to the NCLT.
  • These members were appointed for a period of five years from the date of taking charge or till they attain the age of 65 years, whichever is earlier.
  • The NCLT has a total of 28 benches, with a sanctioned strength of 63 members. This includes 31 each from the judicial and administrative sides along with its president, who heads the principal bench in New Delhi.

Second Digital Lok Adalat

  • National Lok Adalat will be held across the country on 12th November this year to dispose off pending cases through settlement. Consumer Affairs, Food and Public Distribution Ministry said that there are about six lakh eight thousand consumer cases pending in the country. It said, considering the benefits of the Lok Adalat system and mutual settlement between parties a large number of consumer cases are expected to be disposed off.

Law Commission Constituted After 4 Years; Justice Ritu Raj Awasthi Appointed As Chairperson

  • The Central Government appointed chairperson and members of the Law Commission over two and a half years after it was constituted. Retired Karnataka High Court Chief Justice Rituraj Awasthi was appointed as the chairperson of the commission.
  • Former Kerala High Court judge Justice K.T. Sankaran, Professor Anand Paliwal, Professor D.P. Verma, Professor Raka Arya and M. Karunanithi were appointed as members of the commission.
  • Justice Rituraj Awasthi was a judge of the Allahabad High Court and retired in July 2022 as the Chief Justice of Karnataka High Court.
