Community Guidelines for TCYonline Discussions

This is an online community of students and teachers. Students can post their questions which might be exam questions or generic doubts. Teachers help the students with solutions and proper guidance.

What to do

Be courteous - Being a diverse community of people, we must show respect to each other-s opinions. This will enhance the level and quality of interaction.

Language - While posting content, we must use simple and easy to understand language. Avoid using chat lingo.

Content - Each one of us possess a vast pool of knowledge gained from our academic qualifications and experience. The same originality should reflect in our answers. Do not to copy/paste the content from internet. To back up your information, cite sources wherever necessary. Take care of punctuation like question mark, comma etc. Don-t post abusive content as it may lead to suspension of your account.

Participation - Make sure that your question is placed in the right category and right discussion. This will help us suggest you relevant posts to you. As a community member, you equally share the responsibility to keep the discussion clean. Good answers should be boosted by giving thumbs-up and bad answers must be removed by reporting abusive.

Profile - As a participant, you should have an up-to-date profile so that other participants know whom they are speaking to. It also brings a trust factor in students asking questions.

What not to do

Marketing - You should not promote yourself in your answers by giving contact details. Any such posts are liable to be penalized.

Duplicate Content - After posting a question, wait for the answer. Dont post your query multiple times. Duplicate questions as well as any other form of content will be reported abusive and removed from the site.

Copyright material - Posting copyright material is strongly discouraged. Any legal implications will be borne by the person posting the same.

Directions: The following question consists of a legal proposition/principle and facts. This principle has to be applied to the given facts to arrive at the most reasonable conclusion. Such principle may or may not be true in the real sense, yet you have to conclusively assume it to be true for the purpose of the question. In other words, in answering the question, you must not rely on any principle, except the principle that is given below for the given question. Further, you must not assume any facts other than the facts stated in the question. The objective of this question is to test your interest towards study of law, research aptitude and problem solving ability, even if the 'most reasonable conclusion' arrived at may be unacceptable for any other reason. It is not the object of this question to test your knowledge of law.

Principle: Under Transfer of Property Act, 1882, "Transfer of ownership in exchange for a price paid or promised or part-paid and part-promised is a sale".
Facts: "A made a contract with X to transfer his property of Rs. 10 lakh, provided that X win money in lottery".

Directions: The question consists of two statements, one labelled as Principle(s) and the other as Facts. You are to examine the Principle(s) and apply it/them to the given Facts carefully and select the best option.

Principle: A state is vicariously liable in tort for the negligent acts of its servants, done in the course of non-sovereign functions.
Facts: An Air Force vehicle was carrying the hockey team of Indian Air Force Station to play a match. After the game was over, the driver was going to park the vehicle where he hit a cyclist, who suffered severe injuries. The cyclist brought in a case against the Government to be liable for the damages. It was argued that it was one of the functions of the Union of India to keep the army in proper shape and tune and the hockey team was carried by the vehicle for the physical exercise of the Air Force personnel. Therefore, the Government was not liable.

Decide.

Government is liable for the act of driver.

Government is not liable as the act was sovereign.

The driver of the vehicle is liable.

No one is liable as it was a mere accident.

ABC Ltd. is operating a number of bus services for its employees in Delhi. Raghu, an employee of ABC Ltd., without realising that it was not a bus of his own company, boarded a public bus and soon after the bus met with an accident. Raghu, along with several other passengers, suffered injuries. He seeks to file suit against ABC Ltd. claiming damages. Will Raghu succeed?

Raghu will not succeed as it was his responsibility to board a public sector bus instead.

Raghu will succeed because the driver was anyhow duty-bound to drive carefully.
